Terms of Service

These Terms of Service ("Terms") govern your use of the NullMark link forwarding service ("Service") operated by Melvin Morina ("NullMark", "we", "us", "our"), based in Austria. By using our Service, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Service.

1. Description of the Service

NullMark is a link forwarding service that generates short URLs which redirect visitors to a destination URL specified by the user ("Creator"). The Service may include features such as:

• Browser redirection (redirecting visitors from in-app browsers to native browsers)
• Interstitial pages with countdown timers
• Adult content (18+) age gates
• Click tracking and visit counting
• Third-party tracking pixel integration (Meta, TikTok)
• Custom short URL slugs

2. Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction (whichever is higher) to use this Service. By using the Service, you represent and warrant that you meet this age requirement.

3. Account & License Keys

• Access to the Service requires a valid license key obtained through a paid plan (Basic, Pro, or Lifetime).
• License keys are personal and non-transferable. You must not share, sell, sublicense, or publicly disclose your license key.
• You are responsible for keeping your license key secure. We are not liable for unauthorized use of your license key.
• We reserve the right to revoke license keys that are being misused or used in violation of these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in compliance with all applicable laws. You must not use the Service to:

4.1 Prohibited Content

• Link to content that is illegal under Austrian law, EU law, or the law of the jurisdiction where the content is accessed
• Link to child sexual abuse material (CSAM) — this will result in immediate termination and reporting to law enforcement
• Link to content that promotes terrorism, violence, or incitement to hatred
• Link to malware, phishing pages, or other malicious content
• Link to content that infringes third-party intellectual property rights (copyright, trademarks)
• Engage in fraud, scams, impersonation, or deceptive practices

4.2 Prohibited Behavior

• Attempting to circumvent plan limits (visit caps, link limits) through technical manipulation
• Reverse-engineering, decompiling, or attempting to extract source code from the Service
• Using automated tools (bots, scrapers) to interact with the Service at scale
• Interfering with or disrupting the Service's infrastructure
• Reselling or white-labeling the Service without our written permission

5. Adult Content (18+) — Creator Responsibility

NullMark is used by content creators across various industries, including adult entertainment. If you link to content that is sexual, pornographic, or otherwise intended for adults only, the following obligations apply to you (the Creator):

1. You must enable the 18+ toggle when creating any link that leads to adult content. Our system auto-detects certain known adult platforms (e.g., OnlyFans, Fansly, Fanvue), but auto-detection is not exhaustive. It is your sole responsibility to correctly classify your content.
2. You must comply with all applicable age verification laws in your jurisdiction and the jurisdictions of your audience, including but not limited to the EU Digital Services Act (DSA), the Austrian Audiovisual Media Services Act, and any national age verification requirements.
3. You are solely responsible for ensuring your destination content complies with all applicable laws regarding adult content, including but not limited to performer age verification, consent documentation (e.g., 18 U.S.C. § 2257 if applicable), and content legality.
4. Failure to mark adult content as 18+ constitutes a material breach of these Terms and may result in immediate link deactivation, license revocation without refund, and potential reporting to authorities where required by law.

NullMark is not a content host and does not moderate destination content. We provide a technical forwarding tool with an optional age gate. The age gate (interstitial confirmation) is a user-experience feature, not a legally compliant age verification system. Compliance with age verification laws is entirely the Creator's responsibility.

6. Legal Confirmation & Creator Liability

When creating a link, you are required to confirm the following:

• The destination URL does not contain illegal material
• If the link leads to adult content, you have enabled the 18+ toggle
• You accept full legal responsibility for the content at the destination URL

This confirmation is logged with a timestamp and your IP address. By creating a link, you agree to indemnify and hold harmless NullMark, its operator, and its service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• The content at your destination URL
• Your failure to correctly classify content as adult/18+
• Your violation of applicable laws or third-party rights
• Your use of tracking pixels and the data collected by them
• Any claims by third parties related to your use of the Service

7. Service Availability & Modifications

7.1 No Uptime Guarantee

While we strive to maintain high availability, we do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, infrastructure issues, or circumstances beyond our control.

7.2 Feature Changes & Discontinuation

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with or without notice. This includes, but is not limited to:

• Browser redirection functionality — Our Service includes technical methods to redirect users from in-app browsers to native browsers. Third-party platforms (Instagram, TikTok, Facebook, etc.) may change their technical implementation at any time, which could render this feature partially or fully inoperable. We are not liable for changes made by third-party platforms that affect the functionality of the Service.
• Tracking pixel support — Changes by Meta, TikTok, or other platforms to their pixel technology may affect tracking functionality.
• Interstitial page design — We may change the appearance and behavior of interstitial/redirect pages.

7.3 No Refund for Feature Changes

If a specific feature becomes unavailable due to changes by third-party platforms, you are not entitled to a refund solely on that basis, provided the core forwarding service remains operational. The core service is URL forwarding — additional features (browser redirection, pixel tracking, etc.) are provided on a best-effort basis.

This does not affect your statutory rights under Austrian and EU consumer protection law. If the Service as a whole becomes permanently unavailable, refund rights under the Austrian Consumer Protection Act (KSchG) and EU consumer law apply.

8. Third-Party Platforms

NullMark is an independent service and is not affiliated with, endorsed by, or sponsored by Instagram, TikTok, Facebook, Meta, OnlyFans, Fansly, Fanvue, or any other platform mentioned on our website or in our Service.

Our Service interacts with third-party platforms' technical behavior (e.g., in-app browsers). We do not violate any criminal or civil law by providing URL forwarding. However:

• Using NullMark links may violate the terms of service of certain platforms. You are responsible for ensuring your use complies with the terms of platforms you use.
• We are not liable if a third-party platform blocks, restricts, or penalizes links to our Service or your account on their platform.
• We do not guarantee compatibility with any specific platform or browser.

9. Payments, Subscriptions & Refunds

9.1 Pricing & Billing

• Prices are displayed on our website and are charged in USD. Applicable taxes (including Austrian VAT where required) may apply.
• Subscriptions (Basic, Pro) renew automatically at the end of each billing period (monthly or yearly) unless cancelled before renewal.
• Lifetime licenses are one-time payments and do not renew. "Lifetime" refers to the operational lifetime of the NullMark service, not the lifetime of the purchaser. If NullMark ceases operations, is discontinued, or is permanently shut down, lifetime licenses will expire accordingly. No refunds or compensation will be owed in such an event. NullMark makes no guarantee of indefinite or perpetual service availability.

9.2 Cancellation

• You may cancel your subscription at any time through the cancellation feature on our website (using your license key).
• Upon cancellation, you retain access until the end of your current billing period. No prorated refunds are given for partial periods.
• After cancellation takes effect, your license key is deactivated and your links will stop functioning.

9.3 Refunds

• Given the digital nature of the Service, refunds are handled on a case-by-case basis in accordance with Austrian and EU consumer law.
• Under the Austrian Consumer Protection Act (KSchG) and the EU Consumer Rights Directive, you may have a 14-day withdrawal right for digital services. However, by using the Service immediately after purchase (generating a link, using your license key), you acknowledge that the digital service has been fully provided and you waive your right of withdrawal in accordance with Art. 16(m) of the EU Consumer Rights Directive and § 18(1)(11) FAGG.
• If the Service is fundamentally defective or unavailable, statutory warranty rights (Gewährleistung) under Austrian law (ABGB §§ 922 ff.) apply.

9.4 Price Changes

We reserve the right to change pricing at any time. Existing subscriptions will not be affected until their next renewal. We will notify you of price changes at least 30 days before they take effect.

10. Intellectual Property

• The NullMark name, logo, website design, and source code are the property of NullMark / Melvin Morina and are protected by applicable intellectual property laws.
• You may not copy, modify, distribute, or create derivative works of any part of the Service.
• You retain all rights to the content at your destination URLs. By using the Service, you grant us a limited license to display your destination URL in our system for the sole purpose of providing the forwarding service.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

1. NullMark shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.
2. NullMark shall not be liable for any damages arising from:
   • Changes to third-party platforms that affect the Service's functionality
   • Content at destination URLs provided by users
   • Unauthorized access to your license key
   • Service interruptions or downtime
   • Data collected by user-configured tracking pixels
   • Actions taken by third-party platforms against your account
3. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to NullMark in the 12 months preceding the claim.

These limitations do not apply to liability for (a) intentional misconduct or gross negligence (grobe Fahrlässigkeit) under Austrian law, (b) personal injury or death, or (c) any liability that cannot be excluded under mandatory Austrian or EU law.

12. Termination

12.1 Termination by You

You may stop using the Service and cancel your subscription at any time.

12.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if:

• You violate these Terms (especially Sections 4, 5, or 6)
• You use the Service for illegal activities
• We are required to do so by law or court order
• Your use poses a security risk or may harm other users

Upon termination for cause, no refund will be issued. Your links will be deactivated immediately.

12.3 Effect of Termination

Upon termination of your account (by you or by us), your links will cease to function. We may retain certain data as required by law (see our Privacy Policy).

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• That the Service will be uninterrupted, error-free, or secure
• That the browser redirection feature will work on all platforms, devices, or browser versions
• That third-party platforms will not block or restrict NullMark links

This does not affect mandatory warranty rights under Austrian consumer law (Gewährleistung, ABGB §§ 922 ff., VGG).

14. Governing Law & Jurisdiction

• These Terms are governed by the laws of the Republic of Austria, excluding its conflict of law provisions and excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
• Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Austria.
• If you are a consumer within the meaning of the Austrian Consumer Protection Act (KSchG), mandatory consumer protection provisions of your country of residence apply to the extent they provide a higher level of protection. In this case, you may also bring proceedings in the courts of your habitual residence.
• Online Dispute Resolution: The European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. For material changes, we will provide at least 30 days' notice where possible. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
